Update on the Tobacco and Vapes Licensing Regime

The Government has provided an update on the proposed licensing regime for the retail sale of tobacco, vapes and nicotine products.

Consultation delayed until 2027

The planned consultation on the introduction of a licensing scheme has been delayed and is now expected to commence in 2027.

The Tobacco and Vapes Act 2026 provides powers for the introduction of a licensing regime across England, Wales and Northern Ireland, which would regulate the retail sale of tobacco, vaping and nicotine products.

Current situation

The Government continues to analyse responses received during its Call for Evidence, which ran between October and December 2025.

The Call for Evidence sought views on:

  • Possible licensing models for retailers;
  • Measures to support compliant businesses;
  • Approaches to tackling illicit sales and improving enforcement.

Other changes to be introduced first

A number of provisions within the Tobacco and Vapes Act will be implemented ahead of the licensing regime, including regulations relating to:

  • Product packaging requirements; and
  • Retail display restrictions.

Key implementation dates

The Government has advised that:

  • Smoke-free generation provisions are expected to come into force in January 2027.
  • Advertising and sponsorship restrictions for vapes and nicotine products are expected to commence in June 2027.
